Failing to Identify Driver Costs Motorist
£250 and 6 Penalty Points

On 14/5/09, Robyn COAD aged 21 yrs from Brixham, pleaded guilty to the offence of Failing to Identify the Driver of her vehicle contrary to sec 172 of the Road Traffic Act 1988.

The circumstances relating to this offence are in connection with a speed related Safety Camera Offence that occurred on Penwill Way Paignton, Devon, at 1406 hrs on 6th May 2008.

The registered keeper of the black AUDI TT motor vehicle, registration number W76MJM, Robyn COAD, was sent a combined notice of intended prosecution and 172 notice, requesting the name of the driver of the vehicle at the time of the alleged offence. COAD failed to complete this form in the correct manner.  Her mother subsequently wrote 10 letters to the Safety Camera Unit questioning the legality of the prosecution process.  Despite being given a full explanation on several occasions the form was never completed as requested.   

On the day of the trial she pleaded guilty to failing to identify the driver.  She claimed financial hardship by stating that she lived with her parents and earned only £99 per month as a part time shop assistant.

She was fined £135 with costs of £100 and victim surcharge of £15. Her driving licence was endorsed with 6 penalty points.
